General Terms and Conditions
1. Purpose
These general sales and delivery conditions apply in addition to the individual supply agreement and settle the transactions between you, our customer (resellers and end customers) and Blackstore
2. Supply Agreement
The supply agreement is conducted orally (by phone), in writing (mail) or electronically (fax, e-mail, FTP, etc.).
3. Rates
The prices listed on our web page are in Swiss francs, or in the selected currency (which is calculated using the prevailing daily exchange rate), and includes ex works, customs and VAT. Prices listed do not include shipping and handling, insurance or any additional costs incurred.
4. Payment Terms
Orders are shipped after full payment in advance, credit card, Swiss Postcard, Paypal or cash.
If we have previously agreed we accept also bills and checks. Partial deliveries are to be paid per each delivery. All sales are final and complete upon receipt of your order.
5. Delivery times
The delivery times are set in a separate delivery agreement. We have the right to extend the delivery time, if higher forces or circumstances beyond our control delay the on-time delivery. A delivery delay does not entitle you to damages or refund. If the delivery is delayed or made impossible for reasons that we are not responsible, we store the goods at your expense and risk. Blackstore’ standard delivery time is up to 14 days from the date your order is received. Goods that have been custom made, are currently out of stock, or certain specialist products (that may experience production delays, and/or which rely on components from third party suppliers), may result in a delivery time of up to 36 weeks.
6. Transport and insurance
Deliveries are shipped under your own cost and risk. We select the best shipping method to your place of delivery.
Complaints should be sent immediately and directly to the shipper used. If you desire insurance on your shipment you will assume all costs incurred to insure said shipment. We will insure said shipment upon receipt of funds necessary to cover all costs to insure shipment, insurance of shipment is not a guarantee of delivery.
The price for personal delivery is only valid in central Europe. For more charge other places are available. Please ask for the costs. Delivery outside Switzerland and Europe can result in more costs. (Taxes, customs etc.)
7. Passing of benefit and risk
Buyer assumes all risk and liability of shipment to address buyer specifies on order. In case of delayed or non delivery of goods buyer assumes all incured costs of redelivery, storage, reshipping, or loss of goods.
8. Returned goods
It is the buyers responsibility to promptly and thoroughly inspect all shipped goods for damage or incorrect order, any damages incurred during shipping must be reported to shipping carrier and not Blackstore, any order that has been improperly filled must be reported to Blackstore within 5 days of receipt of shipment or claim will not be honored, claims must be filed with a written note and accompanied with the delivery invoice.
If you don´t, the delivery counts as accepted. Unpacked goods cannot be exchanged for hygienic reasons.
9. Warranty
Blackstore guarantees that all products sold by us shall be free of defects in workmanship and operation setforth by our suppliers, Blackstore therefore is not liable for defects that were introduced in production of the product outside our facilities.
Any complaints regarding defects of materials or workmanship will be handled swiftly and courteously. Defects that occur during the warranty period will be fixed at no charge to the customer provided customer has provided us (Blackstore) with the proper form in a timely manner, upon receipt and inspection of defective product(s) we will decide if we shall replace or repair the product. The customer can derive no further rights from defective products, in particular no right to a lowering of the purchase price or a cancellation of the sale. Any related goods shall be also returned with the defective product sealed in the original packaging, customer agrees to pay all shipping costs to Blackstore of defective product(s). There is no right of exchange for products made to measure. Blackstore is not liable for custom-made products in which Blackstore did not collect the data itself. Any products that under inspection appear to have been directly or indirectly damaged by customer will not be repaired or replaced for free under this agreement, if customer wishes to have products repaired or replaced at their cost customer must inform Blackstore of such wishes.
10. Remissions of retailers
As a retailer/reseller you have in exceptional cases a legal recourse to the extent as listed in your written supply agreement. With the correct remittance response all products supplied should only be returned on the approved date and with the proper authorization. Any items not returned in the products original packaging in same condition as you received them will make the remittance null and void until missing products are returned, all returns are at the retailers/resellers expense.
12. Other provisions
Other provisions such as your own only apply to this agreement if both you the customer and us (Blackstore) have agreed in writing to add them and honor them.
13. Performance, appicable law and jurisdiction
Blackstore executes its business in Nendeln, Liechtenstein. All contracts are governed under Swiss law. Any differences are governed by consensus whenever possible. If an amicable settlement is not reached then the judicial courts of Liechtenstein pass judgement according to Swiss law. Jurisdiction is Nendeln, Liechtenstein.
Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from Blackstore.
Gearblast Event 2021
Health regulations
As for any event, we have to comply with the local Corona/Covid-19 rules. For us this means that both on Friday and Saturday you must be able to show at the entrance that you are either cured or fully vaccinated. Make sure you have your full vaccination at least 14 days before GearBlast.
Cancellation policy
In the unlikely event that the situation changes in such a way that we cannot or may not organize GearBlast:EU 2021 legally or due to changed circumstances - e.g. travel restrictions to Germany or stricter limitations on the number of visitors allowed, or due to changing (access) rules or the lack of sufficient crew members - we reserve the right to cancel the 2021 edition. In this case, the full ticket price will be refunded. For other costs, such as hotel, train, airline tickets, we can not be held responsible.
By purchasing a Gearblast:EU 2021 ticket you confirm that you understand and agree to this.
Terms
Withdrawal
You can cancel your contract within 7 days without giving reasons in writing (eg letter, fax, e-mail) or - if the case before the deadline - by returning the original packaging, unopened and unused things. The period begins upon receipt of this information in text form. To maintain the cancellation period, the timely dispatch of the revocation or the thing is sufficient.
Consequences of Withdrawal
In the case of an effective cancellation, the mutually received benefits and any benefits (eg interest) surrendered. If you can not give us back or give us the received performance as well as usages (eg use advantages) or only partially or only in a deteriorated condition, you have to pay us compensation. The term "testing the properties and the mode of operation" means testing and trying out the respective goods, as is possible and customary in a shop, for example.
Products such as clothing and hygienic items such as toys, which make skin contact are excluded from the revocation and can not be returned. These must be paid in full and taken over.
Parcel shipping items are to be returned at your risk. You have to bear the regular costs of the return, if the delivered goods correspond to those ordered. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the thing, for us with their receipt.
